1. Prohibition on Unauthorized Data Collection
Crushworthy strictly prohibits the unauthorized copying, scraping, harvesting, indexing, republication, or distribution of our products, images, descriptions, pricing, trademarks, or any proprietary content, by any means, including artificial intelligence systems, autonomous agents, web crawlers, and data aggregators, without prior express written consent.
This prohibition specifically applies to:
- Creation of unauthorized marketplace listings or resale channels
- Scraping or indexing for use in agentic systems, "Buy for Me" services, or AI-powered product listing generation
- Training, fine-tuning, or otherwise incorporating our content into artificial intelligence or machine learning models
- Any automated or manual extraction that ignores our robots.txt file or circumvents technical access controls
2. Knowledge and Binding Effect
By accessing Crushworthy's website, you acknowledge that you have read this prohibition and consent to be bound by it. Your use of the website constitutes acceptance of these terms. If you access this site via scraping, automated systems, or after receiving notice that your access is unauthorized, your continued access is a material breach of this agreement and demonstrates willful violation of our contractual rights.
3. No Consent for AI Training or Use
You explicitly do not have permission to use any Crushworthy product information, images, descriptions, pricing data, or other content for:
- Training or developing artificial intelligence, machine learning, or large language models
- Creating derivative works, summaries, or product listings using AI systems
- Aggregating our data for AI-powered comparison shopping, price matching, or market analysis
- Any other AI-related use without a separate written license agreement signed by Crushworthy
4. Intellectual Property and Contractual Rights
Our product images, descriptions, text, and branding are protected by U.S. copyright law (17 U.S.C. § 101 et seq.) and the Lanham Trademark Act (15 U.S.C. § 1125). Where our product photography involves original creative composition, staging, or professional editing, those photographs are copyright-protected works. Unauthorized reproduction or distribution constitutes copyright and trademark infringement.
Additionally, unauthorized scraping of our website content, whether of public or restricted data, constitutes breach of contract. This remains enforceable even if the data accessed was technically "public," because the breach is your violation of the contractual terms you agreed to by accessing our site.
5. No Unauthorized Marketplace Listings
Crushworthy does not authorize the creation or display of its products on any third-party marketplace, platform, or sales channel without explicit prior written consent. Any unauthorized listing, whether manual, automatically generated, or AI-created, is presumed to be:
- Inaccurate and unauthorized
- Inconsistent with Crushworthy's brand and quality standards
- Presenting risk to customers purchasing through unauthorized channels, who assume all responsibility for authenticity and warranty coverage
6. Enforcement Rights
Crushworthy reserves all rights to pursue remedies for breach of contract, copyright infringement, and trademark violations, including:
- Cease-and-desist notices and DMCA takedown requests
- Injunctive relief to halt unauthorized scraping or listing creation
- Damages for breach of contract and intellectual property infringement
- Legal fees and costs (where permitted by law)
- Complaints to third-party platforms hosting unauthorized listings
- Criminal referrals where appropriate
Enforcement is independent of any prior notice or cease-and-desist letter. Continued scraping or unauthorized listing creation after notice demonstrates willful breach and may support enhanced remedies.
7. Reporting
Report unauthorized listings or scraping activity to bestie@crushworthy.com with documentation (URL, screenshots, date) so we may investigate and take appropriate action.
